Kaia Liveaboard General Terms & Conditions

These General Terms and Conditions for KAIA Liveaboard vessel charter (hereinafter: Terms) regulate mutual rights and obligations related to services of accommodation on vessel charter. The original and copy of this General Terms and Condition need to be signed before you do the booking deposit, acknowledging that clients understand and agreed said to these Terms and Condition.

KAIA Charter General Terms

The charter fee for KAIA Charter shall include the following:
  • Private charter accommodation for 6 cabin rooms available, equipped according to the presently effective inventory list, as well as usual charter base services at the time of Vessel delivery (Check in/Check out).
  • Accommodation includes all meals-Breakfast, Lunch, and Dinner. morning or afternoon snack while onboard. All expert guided land and divemaster (for diving packages), one-time soft drink refill on display bar.
  • The inclusions of onboard facilities such as snorkeling equipment, non-motorized water sports equipment like kayak, paddleboard, and floats, WIFI internet with limited accessibility, according to the presently available onboard, Tumbler provided by KAIA Team. For the diving packages, the packages only covering the tank and weight equipment.
  • Group land Transfer for in and out from the vessels in designated location; the client acknowledges that the accommodation for group transfer is to cover 1 Big Luggage and 1 Small Luggage per person. In case there is any additional big luggage need to bring to the vessel, the client needs to inform to the KAIA team before the departure.

Check in and Check Out time.

Our check in and check out time onboard is around 9-12am prior to the departure. Check out time on the last day is at 11 am.

Booking and Payment

The vessel can be book via partner agent, website, phone, email, or directly via our KAIA Team. Chartered Vessel booking may be effective only once the payment has been duly affected, with the detailed as follow:
  • First deposit (Down payment) is required prior the reservation and to be made 30 days before the departure, with the amount of 50% of total charter Fee.
  • The remaining balance payment needs to be made at least 7 days before the departure. KAIA team has rights to change the schedule for the charter date if the payment is not complete before the date mentioned above.
  • Any deviations equipment of vessel of the list of equipment, inventory, or services does not give the agent or client a right to asking for a price reduction.
  • The first deposit and final payment shall be paid (the amount is set out in the price list of KAIA Charter) by transfer only to the KAIA Liveaboard account, with the detailed as follow:

Other exclusion equipment or service fee

The exclusion of KAIA Charter services does not cover any including but not limited to:
  • National Park fee and the other park cost
  • Airplane ticket
  • Hotel/land lodging accommodation
  • Tips for KAIA trip Leader and Crew
  • Any additional requested soft drink prior to first refill in the display refrigerator.
  • Any alcoholic beverages available onboard
  • Dinner on the beach services
  • Barbeque onboard
  • Diving equipment such as: BCD, Mask, Fins, are subjected to availability onboard (available on rent).
  • Diving and personal insurance
  • DSLR Underwater photography services
  • This exclusion applies to both leisure or diving packages and all the additional service charge are based on the pricelist of the exclusions service or equipment onboard.

Company Policy

CANCELATION POLICY
  • The cancellations can be made with deposit is return 50% from the total amount if the agent or client made a cancellations 15 days or more before the departure, with the remaining of 50% from the booking will be charged as service charge. Any cancellations are made before less than 14 days prior to the departure are non-refundable.
  • If the agent or client is unable to fulfil the remaining payment less than 14 days prior to the departure of KAIA Liveaboard for any reason, KAIA shall be free to find another party to take over his rights and obligations to give the booking date to another agent or client.
INSURANCE POLICY
  • KAIA recommended the client to having their own personal travel insurance before departure, the client shall be personally responsible for their own for any safety conduct when the client is onboard at KAIA Liveaboard.
DAMAGE TO VESSEL PROPERTY & LOSS OF RENTAL EQUIPMENT
  • If the KAIA Liveaboard vessel, property, and equipment presently onboard is damaged, the client shall bear the costs incurred for its repair. In case of gross negligence or failure to notify the damage, the client shall bear all costs. Including but not limited to the presently effective inventory lists, subject to availability onboard
  • In case of the loss or damage of rental equipment by the client, the client shall bear the costs incurred for its repair or replacement. Including but not limited to: 

i. Snorkeling equipment, non-motorized water sports equipment like kayak, paddleboard, and floats, WIFI internet with limited accessibility.

ii. Diving equipment: BCD, Mask, Fins, Weight, Scuba Tank, DSLR Camera and underwater housing.

Weather Conditions

The Conditions
  • KAIA liveaboard destinations are in remote area in case there is any prevailing weathers conditions that may cause minor inconvenience, KAIA has rights to modify the trip leisure with the notification to the client at any time for safety and convenient of the trip in any reason.
  • The client will have a notification of the current weather situation located in the designated area and have a full responsibility if there is any inconvenience during the trip if the client is still insisted to do the trip after a notification regarding the weather condition from the KAIA team.
  • The client has rights to reschedule the trip if there is any bad weather condition occur at least 3 days before they do the trip. Subject to availability of KAIA Liveaboard on reschedule date.

Force Majeure

IN CASE ANY FORCE MAJEURE EVENT OCCURS PRIOR TO DEPARTURE, INCLUDING BUT NOT LIMITED TO:
  • Extreme bad weather
  • Any restrictions to traveling from the goverment
  • Terrorism
  • Natural Disaster
  • Political instability or
  • Another external event that is not viable for us to operate the vessels

Kaia has rights to cancel the trip and the client may have an option to reschedule the trip or alternatively receive a full refund.
